Governor’s Executive Order #2020-70 Brings Some Changes to the “Stay Home” Order

On May 1, Governor Whitmer extended and modified the “Stay Home, Stay Safe” order by rescinding Executive Order 2020-59 and enacting Executive Order 2020-70. While much of the order remains the same, there are a few key differences in the new order:

1. Beginning on May 7, the following will be allowed to resume:
a. Workers who primarily perform outdoor work, such as forestry workers, parking enforcement workers, power equipment technicians, and etc.
b. The construction industry (residential and commercial) and related workers, such as plumbers and electricians.
c. Real-estate industry, including agents, appraisers, brokers, inspectors, surveyors, and registers of deeds.
d. Workers necessary to manufacture goods that support workplace modification to forestall the spread of COVID-19.

2. The above industries are subject to enhanced and additional social-distancing rules in Section 11 of E.O. 2020-70.

In addition, according to E.O. 2020-69, the following places of public accommodation must remain closed to public use, occupancy, egress and ingress through May 28:

a. Restaurants, cafes, food courts and other businesses that offer onsite consumption of food and beverage.
b. Bars, pubs, breweries, wineries, distilleries, and other places offering onsite consumption of alcoholic beverages.
c. Hookah bars, cigar bars, and vaping lounges.
d. Theaters, cinemas and performance venues.
e. Libraries and museums.
f. Gyms, fitness centers, sports facilities, exercise studios, and recreation centers.
g. Casinos.

It is still a requirement to wear a face covering in an enclosed public space.
